1. Acceptance of Terms
Welcome to Spliteroo. These Terms of Service ("Terms") govern your access to and use of the Spliteroo mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of the updated Terms.
2. Description of Service
Spliteroo is a bill-splitting application that enables users to:
- Scan receipts using OCR (Optical Character Recognition) technology
- Create and manage bills with multiple participants
- Split expenses equally, by percentage, or custom amounts
- Track balances and settlements with friends and groups
- Organize contacts into groups for easier bill management
- View transaction history and export reports
- Handle multi-currency transactions
The Service is provided for personal, non-commercial use. Spliteroo facilitates tracking and organizing shared expenses but does not process actual financial transactions or payments between users.
3. User Accounts and Registration
3.1 Account Creation
To use the Service, you must create an account by providing accurate and complete information, including your name, email address, and phone number. You must be at least 13 years old (or 16 in the European Economic Area) to create an account.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account.
3.3 Phone Verification
We require phone number verification to ensure account security and prevent fraud. You may receive SMS messages for verification purposes. Standard messaging rates may apply.
4. Subscriptions and Payments
4.1 Subscription Tiers
Spliteroo offers the following subscription tiers:
- Free: Basic features with 3 OCR scans per month
- Pro ($4.99/month): Unlimited OCR scans, advanced features, and priority support
- Family ($7.99/month): Pro features for up to 6 family members
4.2 OCR Credits
Free tier users receive 3 OCR credits per month, which reset on the 1st of each month. Pro and Family tier users have unlimited OCR scans. Unused credits do not roll over to the next month.
4.3 Billing and Payment
Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you authorize us (through these platforms) to charge your payment method on a recurring basis. Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.
4.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage or cancel your subscription through your Apple App Store or Google Play Store account settings.
4.5 Family Plans
Family plans allow up to 6 members (including the plan leader). The plan leader is responsible for payment and can invite or remove members. Family members' access ends if they leave the plan or if the subscription is cancelled.
4.6 Price Changes
We reserve the right to change subscription prices at any time. Price changes will not affect your current billing period and will be communicated to you in advance. Your continued use of the Service after a price change constitutes acceptance of the new price.
4.7 Refunds
All payments are handled through the Apple App Store or Google Play Store. Refund requests must be made directly through these platforms according to their respective refund policies. We do not process refunds directly.
5. User Content and Conduct
5.1 Your Content
You retain ownership of all content you submit to the Service, including bill details, receipt images, and group information ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve the Service.
5.2 Content Accuracy
You are responsible for the accuracy of information you enter into the Service. While our OCR technology strives for accuracy, you should verify all scanned data before creating bills. We are not responsible for disputes arising from inaccurate bill information.
5.3 Sharing with Other Users
When you add participants to a bill or group, you authorize us to share relevant bill information with those users. You should only add participants who you trust and with whom you intend to share expense information.
6. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Impersonate another person or entity
- Harass, threaten, or abuse other users
- Upload or transmit viruses, malware, or other malicious code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Scrape, data mine, or use automated tools to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for commercial purposes without our written permission
- Submit false or fraudulent information
- Interfere with or disrupt the Service or servers
- Use the Service to send spam or unsolicited messages
Violation of this Acceptable Use Policy may result in suspension or termination of your account.
7. Intellectual Property
7.1 Our Property
The Service, including its design, features, text, graphics, logos, and source code, is owned by Spliteroo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
7.2 Trademarks
"Spliteroo" and our logo are trademarks of Spliteroo. You may not use our trademarks without our prior written consent.
7.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without any obligation to compensate you.
8. Disclaimers and Limitations of Liability
8.1 Service Provided "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8.2 OCR Accuracy
While we strive to provide accurate OCR scanning, we do not guarantee the accuracy of scanned receipt data. You are responsible for verifying all scanned information before creating bills.
8.3 No Financial Services
Spliteroo is an expense tracking and organization tool. We do not provide financial services, process payments, or facilitate money transfers. We are not responsible for actual payment transactions between users.
8.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPLITEROO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR DATA; (C) ANY INTERRUPTION OR CESSATION OF THE SERVICE; (D) ANY BUGS, VIRUSES, OR MALWARE; OR (E) ANY ERRORS IN THE SERVICE OR CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100, WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify, defend, and hold harmless Spliteroo and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of another party.
10. Termination
10.1 By You
You may terminate your account at any time by deleting the app and contacting us to request account deletion. Upon termination, your subscription will continue until the end of your current billing period.
10.2 By Us
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if you violate these Terms. We are not liable for any loss or damage resulting from termination of your access.
10.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. Data shared with other users (such as bill information) may remain visible to those users as part of their transaction history. We will delete your personal information in accordance with our Privacy Policy and applicable law.
11. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service. We are not liable for any modification, suspension, or discontinuation of the Service.
12. Governing Law and Disputes
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Spliteroo is registered, without regard to its conflict of law provisions.
12.2 Dispute Resolution
If you have a dispute with us, you agree to first contact us at support@spliteroo.com to attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal resolution.
12.3 Arbitration
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or unauthorized access. You waive your right to participate in a class action lawsuit or class-wide arbitration.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spliteroo regarding the Service.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
13.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
